TERMS OF SERVICE*
1. Upon registration, e-bub agrees to provide you (the "End User") with a service
that enables the "End User" with the privilege to use our service to send and receive
electronic data via e-bub.com. Advertisers agree and understand that not all ads
published by e-bub will work in all borwsers exactly the same. This is an
unfortunate reality of the internet as it is currently constructed. For example
Firefox and Mozilla are [in]capable of publishing what Internet Explorer is
[in]capable of publishing. Advertisers are construed by default to be registered
users of e-bub.com and therefore a "End User."
2. Disclaimer of Warranties and Limitation of Liability - "e-bub" makes no
representations or warranties of any kind whatsoever, with respect to the service
and/or the performance of the service; including without limitation, any implied
warranties of merchantability or fitness for a particular purpose. e-bub does not
warant, guarantee or make any representation regarding the use, or the results
of the use, of the service and/or products posted on the service, in terms of
correctness, accuracy, reliability, currentness, otherwise. The entire risks as
to the results and performance of the service and products is assumed by the
end user. e-bub shall not be liable to the end user for consequential or
incidental damages arising from the use or breach of any payments or contracts;
the failure of delivery; delay in delivery; delievery in nonconforming condition;
the use of the service and/or products found therein; or for any other breach of
contract or duty between the end user, the service's user, or the service itself.
e-bub shall have no obligation to provide the Service, and shall have no
liability to the End User in the event it is unable to do so, as may be determined
in the sole discretion of e-bub.
3. Effectiveness of Agreement - The End Users use of the Service shall not in
any respect whatsoever modify any of the terms, conditions, or restrictions
contained on e-bub's site. All terms and conditions by which the End User
initially acquired the privilege to use the service (the "End User Agreement"),
shall in each and every instance remain subject to the terms, conditions, and
restrictions contained in the End User Agreement. Any and all written or implied
contracts are subject to these published terms.
4. General - Any and all claims or disputes relating to the Service shall be
governed by the laws of the State of Dealware, whereat S N A Services, Inc., the
owner of e-bub.com, is legally headquartered. For the purpose of resolving
conflicts relating to the Service, the End User agrees that venue shall be
in the State of Delaware only; in addition, the End User hereby consents to
the jurisdiction of the federal and state courts in the State of Delaware.
e-bub may assign its rights and delegate its duties with respect to the Service
without providing notice to, or receiving the consent of, the End User.
e-bub at its discretion may accept online payment processors for products and
services sold by it. Accordingly, e-bub and those specific e-bub related products
are subject to the stnadard laws of uniform commercial commerce. The end user
is equally yoked under the said laws if they elect to use such online payment
processors.. Buyer Beware - e-bub assumes absolutely no responsibility for any
purchases made through the system. Any time you join any Income Opportunity
or MLM program, or Matrix Website or purchase a product or service you are
doing so at your own risk. By registering with e-bub you do hearby agree in full
that you release e-bub.com and all its affiliates and officers, employees, members
and owners from any loss you may incur either by using this service, or the aforesaid.
You hereby waive all your rights to file or have filed, any legal action of any type
against e-bub.com, its owners, officers or members, employees and affiliates, and
agree that e-bub, it officers, affiliates, members and employees will not be named by
you or anyone, person, law firm.lawyer, former lawyer, that represents you in any
legal actions past, present, or future or any other actions of any sort in any court in
the USA. That you or anyone that represents you shall never in any case seek
monetary reimbursment from e-bub.com in any shape form or fashion, in any capacity
due to our being a medium for posting of electronic data on the internet.
If you have a disagreement with any businesses then you agree that it is strickly
between you and that business, and e-bub has no part of the dispute. You also agree
that by simply registering with e-bub.com you agree that this is a legal and binding
contract; and that you fully and willingly agree to all conditions mentioned
everywhere in this user agreement and that if you violate any area, or term or
condition set forth in this agreement you will be determined to be in breech of
contract to e-bub.com and you automatically give e-bub at its own discretion the
full right and authority to suspend or terminate your use of the service. We are a
internet service only and have no control of what others do and do not. We do
not issue refunds if the product, service or program turns out not be what you
thought it was, or if it doesn't hold up to your expectations or promises.
You should thoroughly investigate any opportunity before making the decision
to join a service or purchase a product before you buy - if it sounds too good
to be true, it usually is. It should also be noted that by voiding your credit card
transactions to fund your purchases for any reason constitutes credit card fraud
as well as violates many other laws, and will be prosecuted to the maximum extent.
While e-bub may accept MLM and Income Opportunity vendors, you should note
that joining any MLM or Income Opportunity vendor is done at your own risk.
There are many legitimate opportunities on the Internet and each one should be
carefully investigated before making any decision to join. e-bub will not offer
refunds for these or any other purchases. These matters should be taken up with
the vendor.
Restricted Activities. Your information and your activities (including your payments
and receipt of payments if ever occuring) through our Service shall not: be false,
inaccurate or misleading; be fraudulent or involve the sale of counterfeit or stolen
items; consist of providing yourself a cash advance from your credit card (or
helping others to do so), violate e-bub's policies, terms and conditions; infringe
on any third party's copyright, patent, trademark, trade secret or other property
rights or rights of publicity or privacy; violate any law, statute, ordinance, contract
or regulation (including, but not limited to, those governing financial services,
consumer protection, unfair competition, antidiscrimination, or false advertising); be
defamatory, trade libelous, unlawfully threatening or unlawfully harassing; be
obscene or contain child pornography; contain any viruses, Trojan horses,
worms, time bombs cancelbots, easter eggs or other computer programming routines
that may damage, detrimentally interfere with, surreptitiously intercept or expropriate
any system, data or other personal information; or create liability for us or cause us
to lose (in whole or in part) the services of our ISP's or other suppliers, also any
website dealing with hacking , phreaking or any material of such nature will not be
allowed. Violating any of the above terms will result in suspension, termination and
or legal prosecution. If you use, or attempt to use the Service for purposes other
than sending and receiving electronic data and managing your ads, including but not
limited to tampering, hacking, modifying or otherwise corrupting the security or
functionality of Service, your use will be terminated and you will be subject to
damages and other penalties, including criminal prosecution where available.
